Terms of Service

1. Acceptance of Terms

By using Casalert ("the Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These terms constitute a legally binding agreement between you ("Customer", "you") and Casalert, operated by Timur Kharenkov ("we", "us").

2. Description of Service

Casalert is a B2B property alert service that monitors Daft.ie for new rental property listings and delivers matching alerts to customers via WhatsApp. The Service includes:

• Real-time monitoring of publicly available Daft.ie listings
• AI-powered analysis and summarisation of listings
• WhatsApp delivery of matched alerts
• WhatsApp bot for managing search criteria

3. Eligibility

The Service is available exclusively to registered business entities, letting agents, and estate agencies operating in Ireland. By registering, you confirm that you are acting on behalf of a legitimate business.

4. Subscription and Payment

The Service is offered on a monthly subscription basis. The standard price is EUR 149 per month. Promotional pricing (including launch offers) may be available and will be communicated at the time of registration. Early adopters who sign up during a promotional period retain their promotional rate for as long as their subscription remains active and uninterrupted.

A free trial period of one month is available to new customers. No credit card is required for the trial. After the trial period, continued use of the Service requires payment of the applicable monthly fee. We will notify you via WhatsApp before your trial period expires.

5. Cancellation and Data Deletion

You may cancel your subscription at any time by:

• Sending STOP to our WhatsApp bot
• Emailing info@travel-assistant.online

Upon cancellation:

• Alert delivery stops immediately
• Your account enters a 30-day grace period (you can reactivate by messaging the bot)
• After 30 days, all account data and search criteria are permanently deleted
• No refunds are offered for partial months

You may request immediate and complete deletion of all your data at any time by emailing info@travel-assistant.online. We will process deletion requests within 30 days as required by GDPR Article 17.

6. Consent to WhatsApp Messaging

By registering with Casalert, you explicitly consent to receiving WhatsApp messages from our business number (+353 53 920 7787), including:

• Property alert notifications (frequency depends on market activity, typically 1-20 per day)
• Bot command responses
• Service-related communications (subscription reminders, important updates)

You may withdraw this consent at any time by sending STOP. This constitutes valid consent under the ePrivacy Directive (2002/58/EC) and Irish ePrivacy Regulations 2011.

7. Use of the Service

You agree to use the Service only for lawful business purposes. You must not:

• Share your WhatsApp bot access with third parties outside your agency
• Use the Service to collect or aggregate data for resale
• Attempt to reverse-engineer or copy the Service
• Use the Service in violation of any applicable law or regulation
• Send spam or unsolicited messages through the bot

8. Data Processing

We process your data in accordance with our Privacy Policy and applicable data protection law, including GDPR and the Irish Data Protection Act 2018. Key points:

• Your data is stored in Google Workspace (EEA) with enterprise-grade security
• We use sub-processors (Twilio, Anthropic, OpenAI) under Data Processing Agreements with Standard Contractual Clauses
• No personal data is shared with AI services - only property listing data is analysed
• You may exercise your GDPR rights (access, rectification, erasure, portability) at any time

9. Property Listings and Data Sources

Property listing data is sourced from Daft.ie, which is publicly available. Casalert does not own or guarantee the accuracy of this data. Listings are provided for informational purposes only. You should independently verify any property information before acting on it.

AI analysis (price assessment, quality score) is generated by automated systems and represents an estimate, not professional valuation. We do not accept liability for decisions made based on AI analysis.

10. Service Availability

We aim to provide continuous monitoring of Daft.ie but do not guarantee 100% uptime or that every new listing will result in an alert. The Service depends on third-party infrastructure (Daft.ie, Twilio, Google Cloud) and may be affected by outages outside our control.

11. Limitation of Liability

To the maximum extent permitted by Irish law, Casalert shall not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service, including but not limited to loss of business opportunities, lost revenue, or missed property listings.

Our total liability to you in any calendar month shall not exceed the subscription fee paid by you in that month.

12. Changes to the Service or Terms

We reserve the right to modify these Terms or the Service at any time. We will notify active customers of material changes via WhatsApp with at least 14 days' notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ireland.
